1. Agreement to Terms

By accessing or using SellMyRace ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

SellMyRace is a marketplace platform that facilitates the transfer of race entries between buyers and sellers. We provide an escrow service to protect both parties during transactions. SellMyRace acts as an intermediary and is not a party to the transfer agreement between buyers and sellers.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Not be prohibited from using the Service under applicable law

4. User Accounts

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised access

5. Listing Race Entries

As a seller, you represent and warrant that:

  • You are the legitimate holder of the race entry
  • You have the right to transfer the entry
  • All information provided about the entry is accurate
  • You will complete the transfer process promptly once a buyer pays

Important: Some race organisers prohibit or restrict entry transfers. It is your responsibility to verify that the transfer is permitted under the race's terms and conditions. SellMyRace is not liable for transfers that are rejected by race organisers.

6. Purchasing Race Entries

As a buyer, you acknowledge that:

  • You are responsible for verifying the entry meets your requirements
  • Some races may require identity verification on race day
  • Transfer success depends on the race organiser's policies
  • You must confirm receipt of the entry within the specified timeframe

7. Escrow and Payments

Our escrow service works as follows:

  • Buyer's payment is held securely by SellMyRace
  • Seller initiates the transfer through the race organiser
  • Buyer confirms receipt of the transferred entry
  • Funds are released to the seller minus our service fee

Our service fee is 5% of the transaction value. This fee is non-refundable once a transaction is completed.

8. Disputes and Refunds

In case of disputes:

  • Either party may raise a dispute within 7 days of the transaction
  • We will investigate and attempt to mediate a resolution
  • Refunds may be issued at our discretion based on evidence provided
  • Our decision on disputes is final

Refunds will be processed within 5-10 business days to the original payment method.

9. Prohibited Activities

You agree not to:

  • List entries you do not own or have the right to sell
  • Provide false or misleading information
  • Attempt to circumvent our escrow system
  • Engage in fraudulent activities
  • Violate any applicable laws or regulations
  • Interfere with the proper functioning of the Service

10. Limitation of Liability

SellMyRace facilitates transactions between users but does not guarantee that transfers will be successful. We are not liable for actions of race organisers, including rejection of transfers. To the maximum extent permitted by law, SellMyRace shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless SellMyRace and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
